1. Agreement. By accessing or using the Filmoyo platform (“Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms are a binding agreement between you (“User”) and Filmoyo (“Company,” “we,” “us”).
2. The Service. Filmoyo is an AI film creation application: you provide descriptions, scripts, and inputs; the Service generates, edits, and exports video and related media, using AI models operated by us and by third-party providers.
3. Your account. You are responsible for your account credentials and for activity under your account. You must be at least 18 (or the age of majority in your jurisdiction) to purchase.
4. Acceptable use. You may not use the Service to create or distribute: content that uses or imitates the likeness, voice, or identity of any real person without their express, verifiable consent (including deepfakes and non-consensual imagery); content promoting violence, hatred, or discrimination against protected groups; sexual content involving minors; content that infringes others’ intellectual-property or privacy rights; or content that violates applicable law. We may suspend or terminate accounts that violate this section.
5. Your content and outputs. You retain your rights in the inputs you provide. Subject to these Terms and applicable third-party model licenses, you may use the outputs you generate, including commercially where your license tier permits. You are solely responsible for reviewing outputs and for your use of them.
6. Credits and purchases. The Service operates on credits included with your purchase or bought as top-ups. Credits are a usage meter, not currency, and have no cash value. Purchases are processed by our authorized retailer (JVZoo) or payment processors. Your purchase is covered by a 30-day money-back guarantee as stated on the offer page; separately-purchased credit top-up packs are consumable and non-refundable, and credits consumed before a refund is processed are not recoverable. Our Refund Policy forms part of these Terms and governs how to request a refund and how requests are processed.
7. Third-party models and services. Some features run on third-party AI models and services (including, where you connect your own API keys, providers you choose such as ElevenLabs). Your use of those features is also subject to the relevant provider’s terms, and it is your responsibility to comply with them.
8. Export controls. You may not use the Service if you are listed on any applicable government list of prohibited or restricted parties or located in an embargoed jurisdiction.
9. Disclaimers and liability. The Service is provided “as is.” AI output may contain errors or artifacts. To the maximum extent permitted by law, our aggregate liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim.
10. Changes; termination. We may update the Service and these Terms; material changes will be reflected by the “Last updated” date. You may stop using the Service at any time; we may suspend accounts for breach.
11. Governing law. These Terms are governed by the laws of the State of Delaware, United States. Disputes shall be resolved through binding arbitration under the AAA Consumer Arbitration Rules.
